AGREEMENT TO OUR LEGAL TERMS

USER REPRESENTATIONS

  • Interfere with, disrupt, or create an undue burden on the Services or the networks or services connected to the Services.
  • Harass, annoy, intimidate, or threaten any of our employees or agents engaged in providing any portion of the Services to you.
  • Attempt to bypass any measures of the Services designed to prevent or restrict access to the Services, or any portion of the Services.
  • Copy or adapt the Services software, including but not limited to Flash, PHP, HTML, JavaScript, or other code.
  • Except as permitted by applicable law, decipher, decompile, disassemble, or reverse engineer any of the software comprising or in any way making up a part of the Services.
  • Except as may be the result of standard search engine or Internet browser usage, use, launch, develop, or distribute any automated system, including without limitation, any spider, robot, cheat utility, scraper, or offline reader that accesses the Services, or use or launch any unauthorized script or other software.
  • Use a buying agent or purchasing agent to make purchases on the Services.
  • Make any unauthorized use of the Services, including collecting usernames and/or email addresses of users by electronic or other means for the purpose of sending unsolicited email, or creating user accounts by automated means or under false pretenses.
  • Use the Services as part of any effort to compete with us or otherwise use the Services and/or the Content for any revenue-generating endeavor or commercial enterprise.
  • Do not upload, download, post, email, or otherwise transmit any materials (including text, data, photos, graphics, or stitch files) that are unlawful, harmful, threatening, abusive, vulgar, harassing, defamatory, obscene, pornographic, profane, indecent, inflammatory, libelous, tortuous, hateful, racially, ethnically, socially, politically, legally, morally, or religiously objectionable, or invasive of another’s privacy, including but not limited to any personal data of others without their consent.

INTELLECTUAL PROPERTY RIGHTS

The Services and their original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of Equifense Technologies Private Limited and its licensors. The Services are protected by copyright, trademark, and other laws of both India and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

COPYRIGHT INFRINGEMENTS

We respect the intellectual property rights of others. If you believe that any material available on or through the Services infringes upon any copyright you own or control, please notify us immediately.

TERM AND TERMINATION

We may terminate or suspend your account and bar access to the Services immediately, without prior notice or liability, if we determine, in our sole discretion, that you have breached these Legal Terms or any applicable law or regulation. Upon termination, your right to use the Services will cease immediately. If you wish to terminate your account, you may simply discontinue using the Services.

MODIFICATIONS TO THE SERVICES

We reserve the right to withdraw or amend the Services, and any service or material we provide via the Services, in our sole discretion without notice. We will not be liable if for any reason all or any part of the Services is unavailable at any time or for any period.

DISCLAIMERS

The Services are provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind. We do not warrant that the Services will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

LIMITATION OF LIABILITY

To the fullest extent permitted by law, in no event will we, our affiliates, or our and their respective officers, directors, employees, agents, or licensors be liable to you or any third party for any indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profits, whether or not we have been advised of the possibility of such damages.

GOVERNING LAW

These Legal Terms and your use of the Services will be governed by and construed in accordance with the laws of India, excluding its conflicts of law principles.

DISPUTE RESOLUTION

Any legal suit, action, or proceeding arising out of, or related to, these Legal Terms or the Services shall be instituted exclusively in the courts of India, and you consent to the jurisdiction of such courts.

MISCELLANEOUS

These Legal Terms constitute the entire agreement between you and us regarding the use of the Services. Our failure to enforce any right or provision of these Legal Terms will not be deemed a waiver of such right or provision. If any provision of these Legal Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect. Any waiver of any provision of these Legal Terms will be effective only if in writing and signed by a duly authorized representative of Equifense Technologies Private Limited.
